1. Acceptance of Terms
By creating an account with Elnora Industries Inc, you agree to be bound by these General Terms and Conditions. If you do not agree to these terms, please do not create an account or use our services.
2. Platform Description
Elnora Industries Inc operates a technology platform connecting customers with independent service providers (franchisees) who perform on-site work including snow removal, lawn care, and related home services. We facilitate service requests, process financial transactions, and provide tracking and reporting. We do not directly perform physical services; all on-site work is performed by independent franchisee businesses that meet Elnora Industry's standards, including the requirement for their own liability insurance.
2.1 Service Standards
Service providers (franchisees) are contractually required to meet the following standards:
- On-demand services: Response and service commencement within 3 hours of order placement
- Interval services: Regular condition checks as specified in your service agreement
- Snow removal interval services: Driveways guaranteed passable during designated commute windows (typically 6:00 AM - 9:00 AM and 4:00 PM - 7:00 PM on weekdays)
- All services: Performed according to current platform Terms and Conditions and industry standards
- Quality standards: Monitored through customer ratings and feedback systems
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You agree to notify us immediately of any unauthorized use.
4. Account Eligibility
You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement and have the legal capacity to enter into binding agreements.
5. Use of Services
You agree to use our platform and services only for lawful purposes. You may not use your account to transmit any harmful, offensive, or illegal content, or to interfere with the operation of our services.
6. Privacy and Data Protection
Your use of our services is governed by our Privacy Policy, available on our website and in your account dashboard. We collect, use, and protect your personal information in accordance with applicable privacy laws. By creating an account, you consent to our data practices as described in our Privacy Policy.
7. Service Availability
We reserve the right to modify, suspend, or discontinue any aspect of our platform services at any time. We do not guarantee uninterrupted or error-free service availability. Availability is subject to franchisee availability and weather conditions.
7.1 Force Majeure
Elnora Industries shall not be liable for delays or failures in service delivery resulting from events beyond our reasonable control, including but not limited to: natural disasters, severe weather, pandemics, epidemics, public health emergencies, war, terrorism, civil unrest, government actions or regulations, platform outages beyond our reasonable control, or other force majeure events. Service providers will make reasonable efforts to complete services, but safety and legal compliance take precedence. During such events, Elnora will provide work-arounds (such as backup service lists) when possible to facilitate service delivery.
7.2 Platform Updates
Elnora Industries may update the platform software, features, or functionality at any time with 72 hours advance notice. Updates may include new features, bug fixes, security improvements, or modifications to existing functionality. We will notify users of material changes through the platform or via email. Continued use of the platform after updates constitutes acceptance of changes. We are not liable for any temporary unavailability or functionality changes during updates.
8. Intellectual Property
All content, features, and functionality of our platform are owned by Elnora Industries Inc and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8.1 Data Ownership
All data collected through the platform, including customer information, property data, service history, transaction records, and usage analytics, is owned by Elnora Industries Inc. You grant Elnora a perpetual, non-exclusive license to use this data to provide and improve services, for business analytics, and for other business purposes as described in our Privacy Policy. 9. Limitation of Liability
To the maximum extent permitted by law, Elnora Industries Inc shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our platform or services. Our liability is limited to the facilitation of services and processing of transactions. All on-site work, work quality, property damage, and related issues are the sole responsibility of the independent franchisee performing the services.
10. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated to you, and your continued use of our services after such changes constitutes acceptance of the updated terms.
11. Dispute Resolution and Governing Law
Any disputes arising from these terms or use of our services shall first be submitted to mediation in New York State. The mediation period shall be 30 days from the date a party requests mediation. If mediation fails to resolve the dispute, the dispute shall be resolved through binding arbitration in New York State in accordance with the rules of the American Arbitration Association. These terms are governed by the laws of the State of New York, without regard to conflict of law principles.

13. Refunds and Disputes
If you are dissatisfied with service quality, you may request a refund through the platform. Refund requests are reviewed by Elnora Industries, which may mediate disputes between customers and service providers. Approved refunds will be processed to your original payment method within 5-7 business days. Refund eligibility is subject to our service standards and terms. Elnora Industries reserves the right to determine refund eligibility based on service delivery, quality standards, and applicable terms. Refund decisions are final.
