1. Acceptance of Terms
By creating an account with Elnora Industries Inc, you agree to be bound by these General Terms and Conditions. If you do not agree to these terms, please do not create an account or use our services.
2. Platform Description
Elnora Industries Inc operates a technology platform connecting customers with independent service providers (franchisees) who perform on-site work including snow removal, lawn care, and related home services. We facilitate service requests, process financial transactions, and provide tracking and reporting. We do not directly perform physical services; all on-site work is performed by independent franchisee businesses that meet Elnora Industry's standards, including the requirement for their own liability insurance.
2.1 Service Standards
Service providers (franchisees) are contractually required to meet the following standards:
- On-demand services: Response and service commencement within 3 hours of order placement
- Interval services: Regular condition checks as specified in your service agreement
- Snow removal interval services: Driveways guaranteed passable during designated commute windows (typically 6:00 AM - 9:00 AM and 4:00 PM - 7:00 PM on weekdays)
- All services: Performed according to current platform Terms and Conditions and industry standards
- Quality standards: Monitored through customer ratings and feedback systems
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You agree to notify us immediately of any unauthorized use.
4. Account Eligibility
You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement and have the legal capacity to enter into binding agreements.
5. Use of Services
You agree to use our platform and services only for lawful purposes. You may not use your account to transmit any harmful, offensive, or illegal content, or to interfere with the operation of our services.
6. Privacy and Data Protection
Your use of our services is governed by our Privacy Policy, available on our website and in your account dashboard. We collect, use, and protect your personal information in accordance with applicable privacy laws. By creating an account, you consent to our data practices as described in our Privacy Policy.
7. Service Availability
We reserve the right to modify, suspend, or discontinue any aspect of our platform services at any time. We do not guarantee uninterrupted or error-free service availability. Availability is subject to franchisee availability and weather conditions.
7.1 Force Majeure
Elnora Industries shall not be liable for delays or failures in service delivery resulting from events beyond our reasonable control, including but not limited to: natural disasters, severe weather, pandemics, epidemics, public health emergencies, war, terrorism, civil unrest, government actions or regulations, platform outages beyond our reasonable control, or other force majeure events. Service providers will make reasonable efforts to complete services, but safety and legal compliance take precedence. During such events, Elnora will provide work-arounds (such as backup service lists) when possible to facilitate service delivery.
7.2 Platform Updates
Elnora Industries may update the platform software, features, or functionality at any time with 72 hours advance notice. Updates may include new features, bug fixes, security improvements, or modifications to existing functionality. We will notify users of material changes through the platform or via email. Continued use of the platform after updates constitutes acceptance of changes. We are not liable for any temporary unavailability or functionality changes during updates.
8. Intellectual Property
All content, features, and functionality of our platform are owned by Elnora Industries Inc and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8.1 Data Ownership
All data collected through the platform, including customer information, property data, service history, transaction records, and usage analytics, is owned by Elnora Industries Inc. You grant Elnora a perpetual, non-exclusive license to use this data to provide and improve services, for business analytics, and for other business purposes as described in our Privacy Policy. 9. Limitation of Liability
To the maximum extent permitted by law, Elnora Industries Inc shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our platform or services. Our liability is limited to the facilitation of services and processing of transactions. All on-site work, work quality, property damage, and related issues are the sole responsibility of the independent franchisee performing the services.
10. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated to you, and your continued use of our services after such changes constitutes acceptance of the updated terms.
11. Dispute Resolution and Governing Law
Any disputes arising from these terms or use of our services shall first be submitted to mediation in New York State. The mediation period shall be 30 days from the date a party requests mediation. If mediation fails to resolve the dispute, the dispute shall be resolved through binding arbitration in New York State in accordance with the rules of the American Arbitration Association. These terms are governed by the laws of the State of New York, without regard to conflict of law principles.

13. Refunds and Disputes
If you are dissatisfied with service quality, you may request a refund through the platform. Refund requests are reviewed by Elnora Industries, which may mediate disputes between customers and service providers. Approved refunds will be processed to your original payment method within 5-7 business days. Refund eligibility is subject to our service standards and terms. Elnora Industries reserves the right to determine refund eligibility based on service delivery, quality standards, and applicable terms. Refund decisions are final.

4. Information Sharing
Franchisees: We share necessary information (name, contact, property addresses, service details) with independent franchisee businesses who perform services at your properties. Franchisees are contractually required to:
- Use data only for service delivery purposes
- Maintain confidentiality of your information
- Not download, share, or retain data after contract termination
- Comply with all applicable data privacy laws
- Immediately lose all data access upon contract termination
Payment Processors: We share payment information with third-party processors to facilitate transactions, subject to their privacy policies.
Service Providers: We may share information with providers who assist in platform operations (hosting, analytics, support tools).
Legal Requirements: We may disclose information if required by law or to protect rights, property, or safety.
Business Transfers: Information may be transferred in connection with mergers, acquisitions, or asset sales.
5. Data Security

Service-Specific Terms

1. Service Types
Elnora Industries facilitates two types of service orders:
1.1 On-Demand Services
Services requested for immediate delivery. Service providers must respond and begin service within 3 hours of order placement. If a service provider cannot meet the 3-hour window, the order may be reassigned or cancelled with a full refund.
1.2 Interval Services (Scheduled Services)
Recurring services scheduled in advance. Service providers perform regular condition checks as specified in your service agreement. For snow removal interval services, driveways are guaranteed passable during designated commute windows (typically 6:00 AM - 9:00 AM and 4:00 PM - 7:00 PM on weekdays). Interval services require customer confirmation 24 hours before each service period begins. If a customer refuses confirmation, the service is cancelled and a refund is processed.
2. Snow Removal Services
2.1 On-Demand Snow Removal
Single snow removal service to be scheduled and completed at the selected address within the next 0 to 24 hours, conditions permitting. Work is guaranteed to begin within 3 hours of the scheduled start time.
2.2 Scheduled Snow Removal
Scheduled from 1 to 365 days in advance for intervals of either 24 hours, 7 days, or 30 days. Includes at least 2 scheduled condition checks per calendar day and snow removal, if necessary (conditions permitting).
2.3 Conditions Permitting
Workers retain the right to refuse snow removal jobs if property conditions are deemed to impede the safe and efficient completion of the work. Adverse conditions include, but are not limited to: solid surfaces in disrepair, snow/ice from prior snow events present, or vehicles or other obstacles that impede access.
2.4 Applicable Surfaces
Snow removal services include clearing of the property's driveway, front walkway, and front steps.
2.5 High Demand Periods
During times of high demand (e.g., major snow events), work crews may make driveways "passable" to motor vehicles with an initial visit, returning later to complete snow removal from applicable surfaces to the customer's satisfaction.
3. Service Standards
All services are performed according to industry standards. Service providers are independent businesses with their own liability insurance. Service quality is monitored through customer ratings and feedback. Elnora Industries mediates disputes and may require service providers to remedy issues.
4. Service Modifications and Cancellations
4.1 Customer Cancellations
On-demand services may be cancelled up to 1 hour before scheduled start time for a full refund. Interval services may be cancelled 24+ hours before the service period for a full refund. Cancellations within 24 hours may be subject to partial charges. Refused interval confirmations result in automatic cancellation and refund.
4.2 Service Provider Cancellations
If a service provider cannot fulfill an order, Elnora will attempt to reassign it to another provider. If no alternative provider is available, the order will be cancelled and a full refund will be issued. No penalty applies to customers for service provider cancellations.
5. Pricing and Payment
Prices displayed at the time of order are final. Prices may vary by territory, property size, and service type. Interval service pricing may be adjusted with 30 days notice. All payments are processed through the Elnora Industries platform. Payment is required at the time of order placement. Refunds are processed to the original payment method within 5-7 business days. Tips are optional and may be added after service completion. Tips are distributed to service providers and their workers. Elnora does not take a percentage of tips.
6. Refunds and Disputes
6.1 Refund Eligibility - On-Demand Snow Removal
Customers will receive a full refund in instances in which a job is refused due to on-site conditions or if work is not initiated within 3 hours of the requested start time.
6.2 Refund Eligibility - Scheduled Snow Removal
Customers may be eligible for a full or partial refund in instances in which scheduled snow removal service orders (i.e., 24 hours, 7 days, 30 day intervals) do not result in at least twice-daily condition checks, passable driveway during targeted access windows (i.e., between 7am-9am and 4pm-6pm), and satisfactory overall snow removal.
6.3 General Refund Eligibility
Refunds may be issued for: service not performed as described, service quality below acceptable standards, service provider failure to meet response time requirements, or property damage caused by service provider (subject to investigation). Submit refund requests through the platform or contact customer support. Elnora Industries reviews requests and may mediate with service providers. Approved refunds are processed within 5-7 business days. Refund decisions are final.
7. Property Damage
Service providers are solely responsible for property damage caused during service delivery. Service providers must maintain adequate liability insurance. Customers should report property damage immediately through the platform. Elnora facilitates communication between customers and service providers regarding damage claims. Elnora may assist in dispute resolution but is not liable for property damage. Final resolution may require insurance claims or legal action between the customer and service provider.
8. Property Access and Weather
You grant service providers reasonable access to your property to perform services. Service providers must respect property boundaries and follow any specific instructions. You are responsible for ensuring gates, locks, or access codes are provided when necessary. Services are subject to weather conditions and safety considerations. Service providers may delay or reschedule services due to severe weather, safety, or legal restrictions. Elnora Industries is not liable for weather-related delays or service modifications.
9. Service Provider Communication
Primary communication should occur through the platform. Customers are not required to interact personally with service providers. Service providers may contact you for on-site service delivery coordination or for disseminating marketing materials (with permission). You may specify communication preferences in your account. Service providers must respect your communication preferences.
10. Changes to Terms
Elnora Industries may update these service terms with 30 days notice. Material changes will be communicated through the platform. Continued use of services after changes constitutes acceptance.
11. Governing Law
